This bulletin explains a new procedure regarding contracts subject to MFEP, as defined in Section 165.5 of the State Finance Law. Please refer to Bulletin G-136 for additional information.

As noted in Bulletin G-136, the Office of the State Comptroller (OSC) established a process for the review and approval of contracts subject to Section 165.5 of the State Finance Law. OSC will review and monitor all bid documents and contract packages to ensure that contractors are in compliance with the MFEP.

To assist in our review, OSC has established a new Contractor Type code "C" for all contractors to whom MFEP apply.

Effective January 1, 1998, Contractor Type code "C" will be required on Contract Encumbrance Requests (AC340) when adding or changing applicable contracts. (Remember: Enter all applicable contractor types when adding a new contract or changing the contractor type field.) Contractor type is a three position field in the Contract Master File in which up to three, one-position codes can be entered. At least one code is required.
