Purpose

To notify agencies of the new process to obtain certification from employees who are receiving a prior year refund of Social Security and Medicare taxes. A new form, AC 3206 - Prior Year Social Security and Medicare Tax Refund Certification, has been developed for this purpose.

Affected Employees

Employees who are entitled to a Social Security and Medicare tax refund due to a Workers’ Compensation award that credited New York State or who were exempt from Social Security and Medicare taxes and taxes were incorrectly withheld

Effective Date(s)

Immediately

OSC Actions

OSC will notify the Social Security Administration of any changes of Social Security and Medicare wages previously reported. OSC will also create the check for the refund.

Agency Actions

Agencies are required to have employees sign and date the AC 3206 before the refund check is released to the employee.
