Return of Certain Arbitration Eligible Employees to Bargaining Units 31 and 61

Purpose

To inform the Department of Environmental Conservation of the procedure to return employees in the titles of Forest Ranger 1, 2 and 3 to the original bargaining units of 31 in the Agency Law Enforcement Services Unit and 61 in the Security Supervisors Unit represented by Council 82.

Affected Employees

Employees in positions with titles of Forest Ranger 1 and Forest Ranger 2 who are currently in Bargaining Unit 81 will be returned to Bargaining Unit 31 effective 6/28/07.

Employees in positions with the title of Forest Ranger 3 who are currently in Bargaining Unit 91 will be returned to Bargaining Unit 61 effective 6/28/07.

Background

Due to the arbitration award that made certain employees in the Agency Law Enforcement Services Unit (BU 31) and in the Security Supervisors Unit (BU 61) eligible for binding arbitration, employees in the titles of Forest Ranger 1 and 2 (BU 31) and Forest Ranger 3 (BU 61) were moved to BU 81 and BU 91, respectively, in December 2006.

Chapter 3 of the Laws of 2007 which implements the agreement between New York State and Council 82 provided for salary increases and additional payments for those employees covered by the agreement. As these employees are now in arbitration eligible bargaining units, employees in Forest Ranger 1, Forest Ranger 2 and Forest Ranger 3 positions and the positions with those titles will be returned to their respective bargaining units.

Note: The retroactive payments were made to these employees in the paycheck dated 6/13/07.

OSC Actions

After processing for Pay Period 7L (Administration), a row will be inserted into the Position Data page for all positions including NYS Positions and the Job Data page as follows:

Position Data

A row will be inserted effective 6/28/07 (Administration). The data will be updated with the new information with an Action Date of the date the process is run.
