Purpose

To inform the agency of OSC’s automatic processing.

Background

Pursuant to Chapter 69 of the Laws of 2009 which implements the Agreement between New York State and the Police Benevolent Association and provides for retroactive General Salary Increases and increases to other payments effective April 1, 2007, April 1, 2008 and April 1, 2009 for Troopers in Bargaining Unit 07 and Commissioned/Non-Commissioned Officers in Bargaining Unit 17.

Contract Provisions and Eligibility Criteria

The legislation provides for the following increases:

April 1, 2007 Retroactive Salary Increase

Bargaining Unit 07 *

  • A retroactive 3% Salary Increase rounded to the nearest dollar for employees in Bargaining Unit 07 for all unit members at the Trainee 2 step and above.
  • Payable effective 4/5/07.
  • 4/1/07 Salary Schedule reflects the 3% increase.

Bargaining Unit 17

  • A retroactive 3% Salary Increase rounded to the nearest dollar for employees in Bargaining Unit 17.
  • Payable effective 4/5/07.
  • 4/1/07 Salary Schedule reflects the 3% increase.

Bargaining Unit 07

  • A retroactive 3% Salary Increase rounded to the nearest dollar for employees in Bargaining Unit 07 for all unit members at the Trainee 2 step and above.

Bargaining Unit 07

  • A retroactive 3% Salary Increase rounded to the nearest dollar for employees in Bargaining Unit 07 for all unit members at the Trainee 2 step and above.
  • Payable effective 4/2/09.
  • 4/1/09 Salary Schedule reflects the 3% increase.

Bargaining Unit 17

  • A retroactive 3% Salary Increase rounded to the nearest dollar for employees in Bargaining Unit 17.
  • Payable effective 4/2/09.

Bargaining Unit 07 Trainee 1 Step

  • Each unit member who was at the Trainee 1 Step ($50,374) during the period of 4/5/07 through 9/16/08 (the date of ratification) shall receive a 3% Salary Increase from 4/5/07 through the completion of their Trainee 1 Step provided the employee was not terminated or on an unpaid leave of absence. For those employees who were rehired or rein leaved on or after 9/17/08, the salary will remain at $50,374.
  • The beginning rate of the Trainee 1 Step will stay at the current 4/1/07 rate for the duration of this contract except for the Trainee 1 employees as noted above.
Location Pay (LPO)

Bargaining Units 07 and 17

An increase in Location Pay to the following amounts:

Location Pay for Monroe County remains at $200.

Supplemental Location Pay (SPL)

Longevity Compensation (LGC)

Bargaining Units 07 and 17

2007

The legislation provides for increases in additional Longevity Compensation effective 4/5/07.

  • 6 to 10 years of service = $430 per year
  • 11 to 15 years of service = $480 per year
  • 16 to 25 years of service = $530 per year

2008

The legislation provides for increases in additional Longevity Compensation effective 4/3/08

  • 6 to 10 years of service = $460 per year
  • 11 to 15 years of service = $510 per year
  • 16 to 25 years of service = $560 per year

2009

The legislation provides for increases in additional Longevity Compensation effective 4/2/09.

  • 6 to 10 years of service = $500 per year
  • 11 to 15 years of service = $550 per year
  • 16 to 25 years of service = $600 per year

OSC Actions

After payroll processing for Pay Period 8L is completed, OSC will automatically insert rows in the Job Data page to reflect the April 2007, 2008 and 2009 retroactive Salary and other Increases for Troopers in Bargaining Unit 07 and Commissioned/Non-Commissioned Officers in Bargaining Unit 17.

  • A row will be inserted in the employee’s Job Data using the Action/Reason code of PAY/SAC (Pay Rate Change/Mass Salary Increase) with an effective date of 4/5/07 (Administration) for the April 2007 increase, 4/3/08 for the 2008 increase and 4/2/09 for the 2009 increase for employees whose status is Active or on Paid Leave of Absence.
  • For employees who were Inactive or on a Leave of Absence without Pay on the effective date of the Increase, a row will be inserted in the employee’s Job Data using the Action/Reason code of PAY/CSL (Pay Rate Change/Correct Salary) with the new salary only if the employee was subsequently returned to the payroll. Rows will be inserted as of the effective date of the return.
  • Any subsequent rows on Job Data also will be updated automatically by inserting additional rows with the Action/Reason code of PAY/CSL (Pay Rate Change/Correct Salary) provided the employee remains in an eligible bargaining unit.
Automatic Increase in Location Pay (LPO)
  • A row will be inserted to update the Additional Pay page with an effective date of 4/5/07 and increase the amount to $1,392 for all employees receiving Location Pay (LPO).
  • A row will be inserted to update the Additional Pay page with an effective date of 4/3/08 and increase the amount to $1,434 for all employees receiving Location Pay (LPO).
  • A row will be inserted to update the Additional Pay page with an effective date of 4/2/09 and increase the amount to $1,477 for all employees receiving Location Pay (LPO).
  • A row will be inserted to update any eligible subsequent rows after the dates of the increases listed above.
Automatic Increase in Supplemental Location Pay (SPL)

Automatic Increase in Longevity Pay (LGC)
  • A row will be inserted to update the Additional Pay page with an appropriate effective date and increase the amount based on the salary schedules above.
  • A row will be inserted to update any eligible subsequent rows after the dates of the increases as noted in the schedule.
Automatic Increase in Expanded Duty Pay (DUT)
  • OSC will automatically insert a row to update the Additional Pay page with an effective date of 4/5/07 and increase the amount to $3,852 for all employees receiving Expanded Duty Pay.
  • OSC will automatically insert a row to update the Additional Pay page with an effective date of 4/3/08 and increase the amount to $5,052 for all employees receiving Expanded Duty Pay.
  • OSC will automatically insert a row to update the Additional Pay page with an effective date of 4/2/09 and increase the amount to $6,252 for all employees receiving Expanded Duty Pay.
  • OSC will automatically insert a row to update any eligible subsequent rows after the dates of the increases listed above.
Automatic Increase in Command Pay (CMD) (BU17 Only)
  • A row will be inserted to update the Additional Pay page with an effective date of 4/5/07 and increase the amount to $289 for all employees receiving Command Pay.
  • A row will be inserted to update the Additional Pay page with an effective date of 4/3/08 and increase the amount to $298 for all employees receiving Command Pay.
  • A row will be inserted to update the Additional Pay page with an effective date of 4/2/09 and increase the amount to $307 for all employees receiving Command Pay.
  • A row will be inserted to update any eligible subsequent rows after the dates of the increases listed above.

Automatic Retroactive Processing

OSC will automatically calculate retroactive payments based on the 4/5/07, 4/3/08 and 4/2/09 Salary Increases and increases to Additional Pay earnings.

Additional Pay earnings that were previously reported as adjustments such as Adjust Location Pay (ALP) will not be retroactively adjusted.

Time Entry earnings that are paid as an amount such as ADJ, OTO, RGO, and SCO will not be automatically adjusted.

The agency must calculate and submit adjustments to these earnings using the Time Entry Earn Code AJR (Adjust Raise).

Retroactive Payments for Employees Receiving Military Stipends

For employees who were placed on Military Stipend Leave with or without pay on or after the effective date of the increases as a result of new military orders, OSC will recalculate the amount of Military Stipend. The recalculations will be processed in Pay Period 9L, paychecks dated 8/19/09.

  • For those employees who received a stipend, the increase in biweekly stipend will be updated on the Job Data record by inserting a new row to reflect the new biweekly stipend amount. Any additional adjustment that is required due to the change in stipend that will not be calculated automatically by the retro process will be reported by OSC in the Time Entry page using the Earn Code AMS (Adjust Military Stipend).
  • For those employees who did not receive a stipend but became eligible for a stipend because of the increased salary, OSC will take the necessary action on the Job Data and/or Time Entry pages to pay the required increases

Control-D Reports

The following Control-D reports will be available after processing of the automatic increases:

NHRP703 Mass Salary Additional Pay Report

This report identifies all employees receiving an automatic increase for Location Pay (LPO), Supplemental Location Pay (SPL), Expanded Duty Pay (DUT), Longevity Compensation (LGC), and Command Pay ( CMD). Fields on this report include EmplID, Employee Record Number, Employee Name, Earn Code, Grade, Salary Plan, Bargaining Unit and Additional Pay Amount.

NHRP704 Mass Salary Payment Report

This report identifies all employees who received the General Salary Increase. The report identifies the employee’s last salary that was automatically increased in an eligible bargaining unit. Other fields on the report include the EmplID, Employee Record Number, Employee Name, Grade, Bargaining Unit, Pay Basis Code, Part-time Percentage, Action Reason and Increment Code.

Deduction Information

All general deductions for employees whose status is Terminated, Retired or Deceased will be automatically cancelled by OSC with the exception of the following:

Undeliverable Checks

Inactive employees may be eligible for a payment as a result of the adjustments. If the agency has made an effort to deliver the check to the employee but the check has been returned and is undeliverable, the agency should forward the check to the NYS Department of Tax and Finance, Division of Treasury, per instructions in Payroll Bulletin No. 908.

Checks issued to eligible employees who are now deceased should be returned with a completed Next of Kin Affidavit (Form AC 934-P) and a Report of Check Exchange (Form AC 1476-P).

For recipients of a previously deceased employee's payroll checks where a Next of Kin Affidavit and Report of Check Exchange forms have been submitted, OSC will accept a photocopy of these forms to process the exchange of the check.

Payroll Register and Employee Paycheck/Advice

All retroactive adjustments will be displayed on the payroll register and the employee’s paycheck stub or direct deposit advice statement
