Exceptions - Minor Interests and Not-for-Profits

There is also an exception related to ownership of stock. This is for interests in contracts arising from corporate stockholdings, but the exception only applies if the municipal officer or employee directly or indirectly owns or controls less then five percent of the corporation’s outstanding stock.

Another exception pertains to contracts in which a municipal officer or employee has only a minor interest. This exception only applies when the total consideration under all of the individual’s contracts with the municipality during the fiscal year does not exceed $750.

There is a statutory exception that applies to contracts with a membership corporation or other voluntary not-for-profit corporation or association, such as contracts with a volunteer fire company.
