Protecting the Public’s Interest: A Tutorial on Local Government Ethics and Transparency in New York State

Module 1 - Conflict of Interest of Municipal Officers and Employees

Exceptions - Pre-Existing Contracts

What happens if a contract existed and then someone with an interest in the contract was elected or appointed? Would the individual's interest in that pre-existing contract be prohibited? No, because Article 18 contains an exception for contracts entered into prior to the time that a municipal officer or employee is elected or appointed. The exception, however, does not apply to a renewal of the contract.
