Apply Your Knowledge - Situation One

A partner in a private law firm has been appointed as town attorney this month. This firm was hired two years ago by the town to represent it in a certain legal matter, which is still in litigation. The town's contract with the firm will continue until the case is settled (either through the courts or by settlement between the two parties).

Is this a prohibited interest in a contract under State statute? Why or why not? If it is not a prohibited interest, are there any other issues that the town should concern itself with?
