Violations of Article 18

What are the consequences of violating Article 18?

  • If a municipal contract is willfully entered into, and a municipal officer or employee has a prohibited interest in the contract, the contract is null, void, and wholly unenforceable. No payment is allowed to be made on the contract.
  • If a municipal officer or employee willfully and knowingly violates the provisions of Article 18 relating to interests in contracts, the individual is guilty of a misdemeanor. Being convicted of this misdemeanor has served as the basis for removing an elected official from office.
