State Contract and Payment Actions in September

In September, the Office of the State Comptroller approved 1,803 contracts for state agencies and public authorities valued at $3.4 billion and approved more than 2.1 million payments worth nearly $15 billion. The office rejected 150 contracts and related transactions valued at $311 million and nearly 3,100 payments valued at more than $13 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Department of Corrections and Community Supervision

  • $35.2 million with Securus Technologies LLC to provide incarcerated individuals with tablet-based technology services.
  • $1.3 million with Maxim Healthcare Staffing Services Inc. for registered nursing services. 

Department of Environmental Conservation

  • $17 million with Tahawus Trails LLC for the maintenance and development of primitive recreational trails in the Adirondack Forest Preserve. 
  • $2.7 million with Sawyer Chrysler Dodge Inc. for 39 Dodge Ram pickup trucks. 

Office of General Services (OGS) – Design & Construction

  • $15.6 million with Gross Electric Inc. to provide fire alarm systems to various OGS facilities at the Empire State Plaza in Albany County.
  • $2.9 million with Massa Construction Inc. for window replacements at the Utica Armory in Oneida County.
  • $2.5 million with Kone Inc. for elevator replacements at the Dulles State Office Building in Jefferson County.
  • $1.5 million with Apache Legend Group Corp. for sub-basement moisture mitigation at the Manhattan Psychiatric Center in New York County.
  • $1.3 million with Burgio and Campofelice Inc. for rehabilitation of latrines and locker rooms at the Buffalo Armory in Erie County.

Department of Health

  • $425.2 million with New York eHealth Collaborative Inc. for management, operation and maintenance of the Statewide Health Information Network for New York (SHIN-NY). 
  • $1.5 million with National Industries for the Blind for operation of the Growing Up Healthy Hotline.   
  • $1.4 million with Temp Force LLC for computer support specialists. 
  • $1.3 million with PerkinElmer Health Sciences Inc. for newborn screening test kits.

Office of Parks, Recreation and Historic Preservation

  • $5 million to the Boy Scouts of America for the purchase of land in Seneca County.
  • $2 million with Mark Cerrone Inc. for exterior stabilization on Schoellkopf Hall at DeVeaux Woods State Park in Niagara County. 
  • $1.6 million with Skanex Pipe Services Inc. for sanitary sewer improvements at the Allegany State Park in Cattaraugus County. 
  • $1.5 with Scott Lawn Yard Inc. for lighthouse shoreline protection at the Golden Hill State Park in Niagara County.

New York State Thruway Authority

  • $4.4 million with Bette & Cring LLC for replacement of the Cauterskill Road Bridge in Greene County. 

Department of Transportation

  • $161.1 million with Posillico Civil Inc. for rehabilitation of seven Grand Central Parkway bridges in Queens County.  
  • $1.5 million with Concrete Applied Technologies Corp. for traffic signal work in Chautauqua, Erie, and Niagara Counties. 

State University Construction Fund

  • $9.3 million with CLS Project Solutions Inc. for renovations to the 7th floor for clinical operations at SUNY College of Optometry in New York County. 
  • $7.4 million with Bast Hatfield Construction LLC to rehabilitate the 3rd floor and multipurpose room at SUNY New Paltz in Ulster County.
  • $2.4 million with Nelcorp Electrical Contracting Corp. for upgrade of the electrical distribution system at SUNY Binghamton in Broome County.

Major Payments Approved

Tax Refunds and Credits                                                      

  • $449.9 million for 99,400 personal income tax refunds.
  • $331.5 million for 433,594 property tax credits. 
  • $216.8 million for 23,337 corporate and other tax refunds.

Department of Civil Service

  • $386.5 million to CaremarkPCS Health LLC to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $35.2 million to Carelon Behavioral Health Inc. for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan. 

State Education Department

  • $2.5 billion in general aid to 677 school districts. 

Empire State Development Corporation

  • $1.9 million to American Packaging Corp. for a portion of the real estate, construction, renovation, machinery, and equipment costs to produce flexible packaging products in Monroe County.   
  • $1.9 million to La Plaza de Virginia Owners LLC for a portion of the demolition and construction costs for a 53,433 square-foot mixed-use, affordable senior housing development in Buffalo in Erie County. 

Office of General Services

  • $11 million for hourly-based IT services, including $2.3 million to Knowledge Builders Inc., $1.1 million to MVP Consulting Plus Inc., and $7.6 million to 25 other vendors.

Department of Health

  • $23.5 million to Maximus US Services Inc. for enrollment broker services for the DOH Office of Health Insurance Programs.
  • $20.1 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $8.6 million to Currier McCabe & Associates Inc. for the development, implementation, and operation of the Medicaid data warehouse and the DOH Office of Health Insurance Programs Data Mart.

Division of Homeland Security and Emergency Services

  • $2.1 million to the Port Authority of New York and New Jersey for the Urban Area Security Initiative Program.

Department of Labor

  • $234 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, and Federal Pandemic Unemployment Compensation programs.

State University of New York Construction Fund

  • $1.1 million to Fahs Construction Group Inc. for the construction of a Health & Wellness Center at the SUNY Upstate Medical University.

Office of Temporary and Disability Assistance

  • $21.6 million for the Emergency Rental Assistance Program.

Department of Transportation

  • $3.6 million to El Sol Contracting ES/II Enterprises JV for bridge repairs on the Gowanus Expressway in Kings County.
  • $1.9 million to the Albany County Airport Authority for the terminal expansion project at the Albany International Airport.

Other Contract and Payment Rejections and Other Cost Recoveries 

DiNapoli’s office rejected tax refunds and credits valued at nearly $2.8 million. Auditors also recovered nearly $206,900 from vendors owing debts to the state and held more than $1.3 million in payments pending resolution of disputes between subcontractors and prime contractors. 

Cumulatively through September for calendar year 2023, DiNapoli’s office approved 17,662 contracts valued at $30.6 billion and approved more than 23.2 million payments worth nearly $142.5 billion. The office rejected 1,553 contracts and related transactions valued at nearly $4.7 billion and nearly 34,200 payments valued at more than $163 million primarily due to errors, improprieties, or lack of documentation.
