Hevesi Signs Executive Orders Protecting Transgender Individuals Transgender and gender variant individuals employed by the Office of the State Comptroller will be fully protected in their workplace by equal opportunity, non-discrimination, affirmative action and non-harassment policies under newly-expanded executive orders signed this month by Comptroller Alan G. Hevesi. “All individuals should be judged and evaluated in the workplace based on their merit, ability and qualifications – and never based on prejudice,” Comptroller Hevesi said. “Some legal decisions have determined that existing protections against discrimination based on sex also protect transgender persons,” Hevesi noted. “However, I believe that it is important to state clearly in our policy that ‘sex’ includes gender identity or expression, thereby ensuring protection. I want to send a message to our staff and to all New Yorkers that I will not tolerate discrimination or harassment.” The Executive Order on Equal Opportunity, Non-Discrimination and Affirmative Action and the Executive Order on Harassment (including Sexual Harassment) now provide expressly that the prohibition against discrimination and harassment based on sex includes a prohibition against discrimination and harassment based on gender identity or expression.
