on Court Ruling Upholding Comptroller’s Authority in
Attorney Pension Benefits Cases
On Friday the Supreme Court, Albany County, rightly upheld my office’s authority to revoke pension fund membership from attorneys incorrectly classified as employees.
The court’s ruling is a victory for the New York State Common Retirement Fund and for the one million members, beneficiaries and retirees of the New York State and Local Retirement System.
In light of the court ruling, my office will review the process we use to notify individuals that their pension benefits may be revoked.
My office will continue to protect the integrity of the pension fund and make sure that only those individuals entitled to a state pension get a state pension.
