State Contract and Payment Actions in May

In May, the Office of the State Comptroller approved 1,717 contracts for state agencies and public authorities valued at $12.6 billion and approved nearly 2.2 million payments worth more than $12.3 billion. The office rejected 163 contracts and related transactions valued at $230 million and more than 3,000 payments valued at nearly $4.8 million. Major Contracts Approved

Office of Children and Family Services

  • $17.2 million with Turnpike Redevelopment Group, LLC for lease space in the city of Rensselaer.
  • $5.3 million with Early Care & Learning Council for child care support services and technical assistance.

Department of Environmental Conservation

  • $9.4 million with Paul Smith’s College for the Adirondack Park Aquatic Invasive Species Prevention Program.
  • $4.1 million with the New England Interstate Water Pollution Control Commission for staff support for source water assessment plans.

Office of General Services

  • $10 million with Jensen Hughes Engineering, PC for construction inspection services at Belmont Park Raceway in Elmont, Nassau County.
  • $3.5 million with Environmental & Fueling Systems, LLC for the Fuel Tank Modification & Environmental Remediation Program.
  • $1.2 million with Anjac Enterprises, Inc. for roof work at Creedmore Psychiatric Center in Queens County.
  • $1.1 million with Sharan Builders, Inc. for exterior masonry restoration for the Health Science Education Building at SUNY Downstate Medical Center in Kings County.

Department of Health

  • $15 million with the SUNY Research Foundation for physician workforce studies.
  • $14 million with Prometric, LLC for the Nurse Aide Registry.

Office of Mental Health

  • $3.5 million with the Mental Health Association in New York State, Inc. for coordination of regional suicide prevention activities.
  • $1.4 million with Families Together in New York State, Inc. for family peer support services.

Office for People with Developmental Disabilities

  • $33.5 million for family support services, including $10.6 million with the New York State Institute on Disability, Inc., $8.6 million with NYSARC, Inc., NYC Chapter, $4.7 million to QSAC, Inc. and $4.1 million with Sinergia, Inc.

Department of Transportation

  • $69 million with Transdev Services, Inc. for operation of the Lower Hudson Transit Link bus service.
  • $40.1 million with National Railroad Passenger Corp. to implement positive train control.
  • $7 million with Hardesty & Hanover, LLC for regional design services in Nassau and Suffolk counties.
  • $5.6 million with American Signal Company, Inc. for portable variable-message signs.
  • $1.8 million with CCI Companies, Inc. for Route 13 at Route 31 intersection improvements in Lenox, Madison County.

Major Payments Approved

Tax Refunds

  • $634 million for 500,000 personal income tax refunds.
  • $278 million for 39,000 corporate and other refunds.
  • $2.7 million for 7,000 property tax credits.

Department of Civil Service

  • $25 million to Beacon Health Options, Inc. for the New York State Health Insurance Program (NYSHIP) Mental Health & Substance Abuse Program.

Empire State Development Corporation

  • $1.6 million to the SUNY Research Foundation for project management services for implementation of Buffalo Billion projects.

Gaming Commission

  • $11.5 million to 10 local governments for tribal compact payments.

Office of General Services

  • $13.5 million for hourly-based IT services, including $2.9 million to PSI International, Inc., $2 million to IIT, Inc., and $1.8 million to Knowledge Builders, Inc.
  • $5.8 million to Prismatic Development Corporation for building renovations for the Manhattan Forensic Relocation project at the Manhattan Psychiatric Center.

Department of Health

  • $27 million to Maximus, Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.

Department of Homeland Security

  • $26.7 million to New York City for the Urban Area Security Initiative Program (UASI).

New York State Legislature – Assembly

  • $16,000 to Roemer Wallens Gold & Mineaux, LLP for outside counsel for independent investigations of sexual harassment.
  • $15,000 to Bracewell, LLP for outside counsel to assist the New York State Assembly with preparation and discovery related to a trial in U.S. District Court in the Southern District of New York.

State University of New York

  • $86,000 to Kelley Drye and Warren, LLP to provide special counsel for SUNY Polytechnic Institute.

Department of Transportation

  • $14 million to Granite Construction Northeast, Inc. for replacement of the Kosciuszko Bridge in Kings County.
  • $10 million to ECCO III Enterprises, Inc. for the Kew Gardens Interchange project in Queens County.
  • $9 million to Yonkers Contracting Company, Inc. to reconstruct Exit 131 at the intersection of Routes 17 and 32 in Orange County.
  • $3.3 million to Intercounty Paving Associates, LLC for pavement preservation in Kings, Queens, Richmond and Bronx counties.
  • $1.4 million to Marcy Excavation Services, LLC for parking lot improvements at the Great New York State Fair grounds in Onondaga County.

New York State Thruway Authority

  • $12 million to Tappan Zee Constructors, LLC for the New NY Bridge Project.
  • $1.6 million to HNTB New York Engineering and Architecture, PC for engineering services for the New NY Bridge Project.

Unified Court System

  • $11 million to The Legal Aid Society for legal services to children and $10 million for legal services to indigent criminal defendants in New York City.
  • $10 million to New York City for court cleaning and minor repairs.

Payment Rejections and Other Cost Recoveries

The office rejected more than 3,000 payments valued at nearly $4.8 million, including tax refunds valued at more than $3.7 million. The Comptroller’s auditors also recovered nearly $44,000 from vendors owing debts to the state, and held payments of more than $1.4 million pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through May for calendar year 2018, the Comptroller’s office has approved 7,302 contracts valued at $38.8 billion and approved nearly 17.8 million payments worth more than $69.7 billion. The office has rejected 829 contracts and related transactions valued at $1.86 billion and more than 15,400 payments valued at nearly $28.3 million primarily due to errors, improprieties or lack of documentation.
