Tier 5 Benefit Information

  • PFRS Members Who Joined January 9, 2010 through March 31, 2012

On December 10, 2009, the Governor signed a bill that amended Articles 14, 15 and 19 and created Article 22 of the Retirement and Social Security Law (RSSL). This resulted in significant changes to the New York State Employees’ Retirement System (ERS) and the New York State Police and Fire Retirement System (PFRS) benefits. ERS members who joined January 1, 2010 through March 31, 2012, and PFRS members who joined January 9, 2010 through March 31, 2012, may be affected by these changes and may be in Tier 5.

  • Registration numbers for ERS Tier 5 members will begin with 5xx.
  • PFRS Tier 5 registration numbers will begin with 0B5. (Registration numbers of PFRS members who joined July 1, 2009 – January 8, 2010 begin with 0B2.)

ERS Tier 1, 2, 3 and 4 members who joined prior to January 1, 2010 and PFRS Tier 1 and 2 members who joined prior to July 1, 2009 will not be affected by this legislation. This legislation does, however, affect those PFRS members who joined July 1, 2009 through January 8, 2010, and elected to be covered by the provisions of Article 22 (Tier 5). It does not affect Tier 3 PFRS members covered by Article 11 or Article 14.
