Legislation changing retirement benefits provided by the New York State and Local Retirement System was signed into law on March 16, 2012 (Chapter 18, Laws of 2012).
Members who join the Employees’ Retirement System (ERS) or the Police and Fire Retirement System (PFRS) on or after April 1, 2012 will be affected by these changes and will be in Tier 6.
Retirement System members who joined before April 1, 2012 will not be affected by this legislation.
You may have employees on your payroll for whom membership in the Employees’ Retirement System was optional and who chose not to join, such as seasonal or part-time employees. If they decide to join ERS, and you register them before April 1, they will be Tier 5 members. Any optional member registrations received on or after April 1 will be designated as Tier 6. Please remember that optional members must be working and on the payroll on their date of membership.

- Fax at 518-486-4382 (the date of membership will be the day the fax is received, provided the valid, hard copy application is subsequently received by mail)
- Phone at 518-474-3081 (the date of membership will be the day the telephone registration is received, provided the valid, hard copy application is subsequently received by mail)
If you register by phone or fax, you still need to mail the valid, hard copy application to us to complete the registration process.

The date of membership is as noted above, not the date your employee signs the membership application or when the application was notarized.
