Divorce and Your Benefits

Overview

These FAQs are intended to provide matrimonial attorneys, Participants, ex-spouses and other interested parties with basic information about the New York State and Local Retirement System (NYSLRS) and how NYSLRS administers Domestic Relations Orders (DRO). They are also intended to answer questions frequently asked by matrimonial attorneys about the benefits NYSLRS provides, the impact a DRO might have on a Participant’s benefits, and the procedures NYSLRS follows when it receives DROs.

These FAQs are based on NYSLRS’s current understanding of the law. They are not intended to be a substitute for New York law or the rules and regulations governing NYSLRS, as law and rules may be subject to change. They are also not intended to provide legal advice to Participants or their ex-spouses and may not be relied upon for that purpose. Participants, ex-spouses and other interested parties are strongly urged to seek the advice of their own attorney or attorneys regarding matters discussed in these FAQs.
