Purpose

To provide agencies with procedures for making Pre-Shift Briefing Adjustments.

Affected Employees

Supervisory staff represented by Council 82 Agency Law Enforcement Services Unit (BU 31), and Council 82 Security Supervisors Unit (BU 61) who have been in positions eligible to receive Pre-Shift Briefing (PS2) in Fiscal Year 2004-2005 and are employed in any of the following agencies:

  • Office of General Services
  • Department of Correctional Services
  • Office of Parks, Recreation and Historic Preservation
  • Department of Health
  • Office of Mental Health
  • Office of Mental Retardation
  • State University of New York

Background

Chapter 73 of the Laws of 2000, which implements the 1999-2003 Agreement for employees in the Security Supervisors Bargaining Unit (BU 61), provides a minimum annual guarantee of $1,248.00 for Pre-Shift Briefing pay for employees who occupied positions in the Unit during Fiscal Year 2004-2005. For employees who do not have a full fiscal year in Bargaining Unit 31 or 61, the annual minimum guarantee is pro-rated at $48.00 per pay period based on the length of service in a Supervisory position during the fiscal year. Employees in Bargaining Unit 61 Supervisory positions that were certified Bargaining Unit 31 Supervisory positions by the Public Employees Relations Board (PERB) on August 19, 2002 retain the same payment eligibility as in their Bargaining Unit 61 contract and should be paid accordingly.

OSC Actions

After Pay Period 1 is processed, Control D Report (NHRP 736) will be available. The report will include any employee who held a position in Bargaining Units 31 or 61 during Fiscal Year 2004-2005 and whose total Pre-Shift Briefing (PS2) amount was less than $1248.00. The Pre-Shift Briefing amount (PS2) they were actually paid in 2004-2005 will also be included on the report. This amount may also include any payments earned in Fiscal Year 2003-2004, but paid in Fiscal Year 2004-2005. If the employee received payments from more than one agency, the report will identify the total paid in the current agency and all other agencies.

Agency Actions

For each employee who may have earned less than $1,248 during Fiscal Year 2004-2005:

  1. Calculate the Pre-Shift Briefing amount the employee was eligible to earn in Fiscal Year 2004-2005.
  2. Determine the amount the employee was actually paid for Pre-Shift Briefing for Fiscal Year 2004-2005.
    • Using the amount identified on the report, subtract any amount that was paid in 2004-2005, but was earned in Fiscal Year 2003-2004 and add any amount paid in Fiscal Year 2005-2006 that was actually earned in 2004-2005. If necessary, contact the employee’s previous agency to confirm the Pre-Shift Briefing amount received.
  3. Determine the amount of Pre-Shift Briefing due by subtracting the total amount paid from the amount the employee was eligible to earn.
  4. Process the adjustment through the Time Entry panel as follows:
Earn Begin Date: Enter the last day of Pay Period 26L (03/30/2005 for Institution) or the last day of Pay Period 27L (04/06/2005 for Administration) or, if the employee is inactive or in another Bargaining Unit on the last day of Pay Period 26L Institution or Pay Period 27L Administration, enter the last day paid in Bargaining Unit 31 or 61.
Earn End Date: Same as the Begin Date
