Background

A recent binding arbitration award was made in accordance with section 209 of the Civil Service Law with respect to certain employees in the Agency Law Enforcement Services Unit (BU 31). Because only certain employees in the Agency Law Enforcement Services Unit are eligible for binding arbitration, the award is limited to those eligible employees.

In order to facilitate the processing of the award and to allow for the continuation of programs and the processing of payments for employees not covered under the award, OSC has partnered with the Department of Civil Service (DCS) to establish a new payroll bargaining unit code, BU 81. This change is implemented purely for administrative purposes and there will continue to be a single bargaining unit, the Agency Law Enforcement Services Unit represented by Council 82, for purposes of the Taylor Law.

Affected Employees

Payroll Bargaining Unit Code 81 has been established for the attached list of non-arbitration eligible titles in all pay basis codes belonging to the Agency Law Enforcement Services Unit (see attachment).

Payroll Bargaining Unit Code 91 has been established for the attached list of non-arbitration eligible titles in all pay basis codes belonging to the Security Supervisors Unit (see attachment).

OSC Actions

OSC has created new codes for the following new data elements with respect to the employees and their positions in the arbitration non-eligible titles.

The Payroll Bargaining Unit Code will be Bargaining Unit 81 (Law Enforcement Services Unit NA). The Union Code will remain C82.

The Payroll Bargaining Unit Code will be Bargaining Unit 91 (Security Supervisors NA). The Union Code will remain C82.

Four new Earnings Programs will be created:

  • Earnings Program N81 (Agy Law Enforcmnt Svcs Unit NA) will replace N31 for non-arbitration eligible employees with an ANN Pay Basis Code.
  • Earnings Program H81 (Agy Law Enforce Svcs Unit NA HRY) will replace H31 for non-arbitration eligible employees with an HRY Pay Basis Code.
  • Earnings Program N91 (Security Supvrs Unit NA) will replace N61 for non-arbitration eligible employees with an ANN Pay Basis Code.
  • Earnings Program H91 (Security Supvrs Unit NA HRY) will replace Earnings Program HRY for non-arbitration eligible employees with an HRY Pay Basis Code.

Note:  There will be no changes for Earnings Programs FEE for employees with a Pay Basis Code of FEE or MST (Military Stipend) for employees who are on a paid military stipend.

The Salary Plans SLE (Agy Law Enforcmnt Svcs Unit NA) and SSU (Security Supvrs Unit NA) will contain the existing salary charts.

After processing for Pay Periods 18 (Administration) and 19 (Institution) is complete, rows will be inserted into the Position Data page for all positions including NYS Positions and the Job Data page as follows:

A row will be inserted effective 3/27/03 (Administration) or 4/3/03 (Institution) if no row with that effective date exists.  If a row exists for that date, the data will be updated with the new information with an Action Date of the date the process is run.

Agency Actions

The locked queries were reviewed by OSC and no modifications are needed. Agencies may need to add the new Bargaining Units 81 and 91 to current agency queries to obtain valid results for the full Agency Law Enforcement Services Unit and the Security Supervisors Unit bargaining units.

Automated Interface

There will be no impact on the Automated Interface file.

Certification Process

This change will not impact the certification process for Pay Period 18 paychecks dated 12/27/06 (Administration) and Pay Period 19 paychecks dated 1/4/07 (Institution).
