Purpose

To advise agencies of the creation of a new union, Police Benevolent Association of New York State, Inc. (PBANYS), that will be representing employees in Bargaining Unit 31.

Background

On May 6, 2011, the Police Benevolent Association of New York State, Inc. filed a petition seeking to represent employees in Bargaining Unit 31. Evidence that it represents a majority of the employees in the Unit was submitted. Pursuant to §201.9(g)(1) of the Rules of Procedure of the New York State Public Employment Relations Board, the petitioner has thereby satisfied the requirements for certification without an election and is eligible to be certified as the exclusive negotiating agent of the unit. The change is effective August 19, 2011. Bargaining Unit 31 was previously represented by Council 82, AFSCME, AFL-CIO.

OSC Actions

OSC has identified all employees in Bargaining Unit 31 and will automatically end date existing dues (code 202) and agency shop fees (code 213) to Council 82 for all employees in the bargaining unit effective August 18, 2011.

Effective August 19, 2011, dues (code 202) and agency shop fees (code 213) collected from employees in Bargaining Unit 31 through payroll deduction have been forwarded by OSC to PBANYS, Inc. OSC will continue this practice up to and including paychecks dated October 26, 2011.

OSC has created Deduction Code 483 (PBANYS Dues) and 484 (PBANYS A/S) which will be effective in paychecks dated November 9, 2011. Dues and agency shop fee rates will remain the same at $16.18 for HRLY employees and $32.37 for ANNUAL and SALARY employees. Deduction Code 484 (PBANYS A/S) will be automatically deducted unless employees choose union membership. Agency Update will not be available.

OSC has created a new Union Code (PBI) for the Police Benevolent Association of New York State, Inc., and has changed the narrative description of Benefit Program 31C to PBANYS Agency Law Enforce Svcs.

General Deduction eligibility remains the same for employees in Bargaining Unit 31. As a result, OSC has changed the narrative description printed on pay stubs and advice statements for the following deduction codes:

OSC has changed the narrative description for Earnings Program N31 to PBANYS Agency Law Enforce Svcs (PBA LES).  OSC has also changed the narrative description for Earnings Program H31 to PBANYS Law Enforce Svcs Hrly (PBA LES Hr).

OSC will automatically update the Job Data and Position Management records of affected employees and positions to reflect the Union Code, Benefit Program and Earnings Program changes.
