Purpose

The purpose of this bulletin is to inform agencies of the automatic processing for the bi-weekly Security Services Hazardous Duty Pay, and to provide instructions for payments not processed automatically.

Affected Employees

All Arbitration eligible employees in Bargaining Unit 01 and Non-Arbitration eligible employees in Bargaining Unit 21 represented by NYSCOPBA are affected.

Background

Chapter 24 of the Laws of 2019 which implements the negotiated 2016–2023 agreement between New York State and NYSCOPBA provides for a bi-weekly Security Services Hazardous Duty Pay payment for employees who have at least one year of service credit in either BU01 or BU21.

Effective Date(s)

The bi-weekly Security Services Hazardous Duty Pay will be paid using the following effective dates:

Eligibility Criteria

Employees in Bargaining Unit 01 or Bargaining Unit 21 who, after 1 year of service in either bargaining unit before the 04/01/2020 eligibility date (determined by an Anniversary Date of on or before 04/01/2019), have a Payroll Status of Active, Leave With Pay, or Leave of Absence with an Action/Reason code of Leave of Absence/WDL (WC Dis Lv) or Leave of Absence/WPS (WC 60% SUP) on the payment effective dates 03/26/2020 (Institution) or 04/02/2020 (Administration) are eligible for the bi-weekly Security Services Hazardous Duty Pay.

OSC Actions

The Office of the State Comptroller (OSC) will increase the following Additional Pay codes according to the chart below:

Control-D Report

After the automatic processing of the Security Services Hazardous Duty Pay is completed, the following Control-D report will be available for agency use:

NHRP703 Mass Salary Additional Pay Report

This report identifies all employees receiving the automatic Security Services Hazardous Duty Pay 01H (Hazardous Duty Pay Arb-Eligib) or 21H (Hazardous Duty Pay Non-Arb). Fields on this report include EmplID, Employee Record Number, Employee Name, Earn Code, Grade, Salary Plan, Bargaining Unit, and Additional Pay Amount.

Agency Actions Beginning in Pay Period 2L

Beginning in Pay Period 2L, agencies must submit transactions for employees who were not eligible on the effective dates 03/26/2020 (Institution) or 04/02/2020 (Administration) but subsequently become eligible.

Submitting Payment

To make the bi-weekly Security Services Hazardous Duty Pay payments to eligible employees who were not systematically processed with the effective dates of 03/26/2020 (Institution) or 04/02/2020 (Administration), agencies must submit the following information on the Additional Pay page using the appropriate Earnings Code:

Overtime Calculation Information

The bi-weekly Security Services Hazardous Duty Pay payment is included in the calculation of overtime compensation (refer to the Online Payroll Manual accessed from the PayServ Bulletin Board – Payroll Manual > Earnings Manual > Time Entry Payments > Overtime Compensation).

If an employee is appointed to an ineligible position effective after receiving the bi-weekly Security Services Hazardous Duty Pay payments, the payments cannot be included in the compensation calculation of any overtime earned after the date of appointment. Therefore, agencies must insert a row on the Additional Pay page at the Effective Date level of Earnings Codes 01H or 21H (as appropriate) and enter the following information:

Annual Addl Earnings: Same as original amount (populates automatically)
End Date: Same as Effective Date
Goal Balance: Same as Annual Addl Earnings (to prevent making another payment)

Tax Information

The bi-weekly Security Services Hazardous Duty Pay payments are taxable income, will be included in the employee’s taxable gross and are subject to all employment and income taxes.

Retirement Information

The bi-weekly Security Services Hazardous Duty Pay payments are included as salary for retirement purposes.
