State Contract and Payment Actions in February

In February, the Office of the State Comptroller approved 1,494 contracts for state agencies and public authorities valued at $4.3 billion and approved more than 3.9 million payments worth more than $9.8 billion. The office rejected 145 contracts and related transactions valued at $190 million and nearly 3,600 payments valued at nearly $15.8 million. Major Contracts Approved

Office of Children and Family Services

  • $14.5 million for comprehensive services for the blind, including $10.2 million with Catholic Charities Community Services of the Archdiocese of New York, $2.9 million with Central Association for the Blind and Visually Impaired, and $1.4 million with Chautauqua Blind Association.
  • $5 million for day care registration and inspection services, including $1.5 million to Child Care Coalition of the Niagara Frontier, Inc. and $3.5 million to Child Care Council, Inc.

Office of Court Administration

  • $264.7 million with New York City for court facility maintenance.

Department of Environmental Conservation

  • $19.5 million to Rochester Institute of Technology for a pollution prevention program.
  • $8.3 million to the US Army Corps of Engineers for the State’s share of costs for sea wall improvement at Montauk Point in Suffolk County.  
  • $1.4 million with Covanta Environmental Solutions, LLC for collection and disposal services for the pharmaceutical take-back program.

Office of General Services – Design & Construction

  • $3.1 million with Digesare Mechanical, Inc. to rehabilitate service tunnels and replace condensate piping at the W. Averell Harriman State Office Building Campus in Albany County.
  • $1.8 million with View-Tech, Inc. to replace windows at the Eleanor Roosevelt State Office Building in Dutchess County.
  • $1.1 million with S & O Construction Services, Inc. to rehabilitate containment systems and piping tanks at the Sing Sing Correctional Facility in Westchester County.

Department of Health

  • $1.1 million with Ahlers & Company for family planning data management and information system services.
  • $5.8 million with HealthHelp, Inc. for radiology management services.
  • $1.8 million with Knowledge Builders, Inc. for the Nursing Home Complaint Intake Program.

Office of Parks Recreation & Historic Preservation

  • $1.5 million with Stantec Consulting Services, Inc. for professional design services in various regions.
  • $1 million with Gallo Construction Corp. for balcony ramp, railing and lighting at the Saratoga Performing Arts Center in Saratoga County.

State University of New York

  • $56.8 million with Sodexo America, LLC for food service management at the SUNY Health Science Center at Brooklyn.
  • $3.8 million with Apogee Telecom, Inc. for dormitory room internet services at Potsdam and Canton colleges.
  • $2.2 million with New York State Industries for the Disabled, Inc. for janitorial services at SUNY Buffalo.

Department of Transportation

  • $26.8 million with Harrison & Burrowes Bridge Constructors, Inc. for NY Route 7 bridge rehabilitation and pavement repair in Albany and Rensselaer Counties.
  • $5.7 million with Bangs Towing, Inc. for towing and emergency road services on Long Island.
  • $4 million with New York State Industries for the Disabled, Inc. for janitorial and grounds maintenance at the Southern Tier Welcome Center in Broome County.
  • $2.8 million with Bothar Construction, LLC for bridge replacement on NY Route 14 over Glenn Creek in Schuyler County.
  • $2.2 million with ELQ Industries, Inc. for traffic signal control upgrades on routes 312 & I-84 in Putnam County.

Major Payments Approved

Tax Refunds

  • $1.7 billion for 500,000 personal income tax refunds.
  • $310 million for 39,000 corporate and other refunds.
  • $3 million for 7,000 property tax credits.

Department of Civil Service

  • $239.3 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $19.7 million to Beacon Health Options, Inc. for the New York State Health Insurance Program (NYSHIP) Mental Health & Substance Abuse Program. 

Empire State Development Corporation 

  • $50 million to Athenex, Inc. for a pharmaceutical manufacturing facility in Dunkirk, Chautauqua County.
  • $10 million to the Office of Parks, Recreation and Historic Preservation for capital improvements to the Buffalo Harbor State Park. 
  • $3.1 million to Community Foundation for Greater Buffalo, Inc. to support programs providing workforce development throughout western New York.
  • $3 million to the 43North, LLC for expenses of the startup business plan competition in Buffalo.
  • $2.6 million to Innovation Group of CNY Arts, LLC to provide incentives for filmmakers to produce motion pictures in Central New York and to develop a short film competition in partnership with Syracuse University and SUNY Oswego.
  • $1 million to Masserson Holdings, LLC to establish a hospitality and tourism destination in Roxbury, Delaware County.

Gaming Commission

  • $5.7 million for tribal compact payments to Cayuga, Chenango, Cortland, Herkimer, Lewis, Oneida, Onondaga, Oswego and Otsego counties.

Office of General Services

  • $8 million for hourly-based IT services, including $1.5 million to IIT, Inc., $1.2 million to Knowledge Builders, Inc., and $1 million to MVP Consulting Plus, Inc.
  • $4.8 million to Prismatic Development Corporation for building renovations for the Manhattan Forensic Relocation project at the Manhattan Psychiatric Center in New York City.

Department of Health 

  • $73 million to Maximus, Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $9.6 million to New York eHealth Collaborative, Inc. for the Statewide Health Information Network for New York.

New York State Thruway Authority

  • $10.5 million to Tappan Zee Constructors, LLC for the New NY Bridge Project.
  • $1.6 million to HNTB New York Engineering and Architecture, PC for engineering services for the New NY Bridge Project.

Department of Transportation

  • $18.1 million to Skanska-Kiewit-Ecco III JV for replacement of the Kosciuszko Bridge in Kings County.
  • $9.2 million to Granite Construction Northeast, Inc. for replacement of the Kosciuszko Bridge in Kings County.
  • $4.1 million to Yonkers Contracting Company, Inc. to reconstruct Exit 131 at the intersection of Routes 17 and 32 in Orange County. 
  • $3.1 million to Chemung County for the modernization and renovation of the Elmira-Corning Regional Airport.
  • $2.5 million to STV Inc., to perform quality assurance services related to the replacement of the Kosciuszko Bridge in Kings and Queens Counties.
  • $2.4 million to ECCO III Enterprises, Inc. for the Kew Gardens Interchange project in Queens County.

Unified Court System

  • $2.9 million to The Legal Aid Society for the Attorneys for Children Program.

Payment Rejections and Other Cost Recoveries

The office rejected nearly 3,600 payments valued at nearly $15.8 million, including tax refunds and credits valued at nearly $10 million.  The Comptroller’s auditors also recovered more than $66,000 from vendors owing debts to the state, and held payments of nearly $700,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through February for calendar year 2019, the Comptroller’s office has approved 3,226 contracts valued at $25.3 billion and approved nearly 5.7 million payments worth more than $20 billion. The office has rejected 313 contracts and related transactions valued at $480 million and more than 6,000 payments valued at nearly $20.5 million primarily due to errors, improprieties or lack of documentation.
