State Contract and Payment Actions in July

In July, the Office of the State Comptroller approved 1,308 contracts for state agencies and public authorities valued at $6.5 billion and approved nearly 27.3 million payments worth more than $19.9 billion. The office rejected 140 contracts and related transactions valued at $120 million and more than 24,400 payments valued at more than $37.7 million, primarily for mistakes, insufficient support for charges, and improper payments. The Governor’s Executive Order 202 suspended the Office of the State Comptroller’s review and approval of contracts related to the COVID-19 crisis until September 4, 2020. At the administration's request, OSC has been expediting payments for purchases. These are reported on Open Book.

Major Contracts Approved

Office of General Services

  • $81.9 million with 250 Broadway Owner LLC for leased space in New York City.
  • $5.8 million with Sharan Builders Inc. to rehabilitate perimeter walls at the Clinton Correctional Facility in Clinton County.
  • $4.8 million with the Capital District Transportation Authority for state employee public transportation passes.
  • $2.5 million with M/E Engineering PC to repair steel cells and utilities at correctional facilities statewide.
  • $1.1 million with Global Electrical Contracting of Westchester Inc. to upgrade electrical switchgear at New York City Children's Center in Queens County.

Department of Health

  • $50.8 million for the Statewide Healthcare Facility Transformation program, including $16.3 million with Crouse Health Hospital, $11.9 million with St Luke’s Cornwall Hospital, $6.6 million with Richmond University Medical Center, $5 million with Care for the Homeless, $3.7 million to Rochester General Hospital, $3.4 million to The Floating Hospital Inc., $2.1 million to Equinox Inc., and $1.8 million to The Fortune Society Inc.

Office of Parks, Recreation & Historic Preservation

  • $23.5 million with J Kokolakis Contracting Inc. to rehabilitate Franklin D. Roosevelt State Park swimming pool and supporting infrastructure in Westchester County.
  • $8.3 million with Fortunato Sons Contracting Inc. for construction of a new Environmental Education and Resiliency Center at Hempstead Lake State Park in Nassau County.
  • $2.3 million with Ben Ciccone Inc. for access road rehabilitation at Minnewaska State Park Preserve in Ulster County.
  • $1.3 million with Trahanas LLC for food and beverage concessions at Robert Moses State Park in Suffolk County.
  • $1.1 million with Riverbank Restaurant LLC for a restaurant and catering concession at Denny Farrell Riverbank State Park in New York County.

State University of New York

  • $8.2 million with Upstate University Medical Associates at Syracuse Inc. for neurosurgery staff medical services at Upstate Medical University.
  • $4.1 million for third party payment collectors to provide follow-up hospital billing and collection services at the Health Science Center in Brooklyn, including $2.1 million with Patient Accounting Service Center LLC and $2 million with Sierra Health Group.
  • $2.2 million with Northwell Health Inc. for the dental residency rotation program at Stony Brook.

Department of Transportation

  • $342 million with Posillico El Sol JV for Van Wyck Expressway to improve capacity and access to JFK Airport in Queens.
  • $15.3 million with Harrison & Burrowes Bridge Constructors Inc. for rehabilitation of the I-90 bridge over Fuller Rd. and the I-90 Bridge over Erie Boulevard in Albany County.
  • $5 million with Morano Brothers Corp. for improvements including ADA curb ramps and signals in Westchester County.
  • $3.9 million with KS Engineers PC for culvert inspection in Western New York.
  • $3.4 million with Dolomite Products Company Inc. for 5.5 miles of asphalt concrete rehabilitation on Route 365 in Oneida County.
  • $3.3 million with Concrete Applied Technologies Corp. for pedestrian safety improvements on Niagara Falls Boulevard in Erie County.
  • $2.8 million with Hanson Aggregates New York LLC for 3.4 miles of asphalt rehabilitation and safety improvements on Route 5 in Herkimer County.
  • $2.6 million with Denville Line Painting Inc. for pavement markings in Albany County.

Tax Refunds

  • $1.3 billion for 933,000 personal income tax refunds.
  • $96.2 million for 14,000 corporate and other refunds.
  • $47.5 million for 98,000 property tax credits.

City University of New York

  • $1.2 million for purchases to support the COVID-19 pandemic response.

Department of Civil Service

  • $256.2 million to CVS Caremark to provide pharmacy benefit services for the NYS Empire, Excelsior and Student Employee Health plans.
  • $24.1 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program for the NYS Empire Plan.

Department of Corrections and Community Supervision

  • $1.1 million for purchases to support the COVID-19 pandemic response.

Department of Education

  • $515,000 in general aid payment to Spackenkill School District.

Empire State Development Corporation

  • $10 million to the Margaret Woodbury Strong Museum for construction and development expenses for a new parking garage in Rochester.
  • $4.7 million to the Edison Welding Institute for the operation of Buffalo Manufacturing Works in Erie County.
  • $4.6 million to Buffalo Bills, Inc. for working capital, capital improvements and game day operations.

Office of General Services

  • $21 million for hourly-based IT services, including $4.2 million to PSI International Inc., $3.8 million to MVP Consulting Plus Inc., $2.2 million to Knowledge Builders Inc., $2 million to IIT Inc., and $8.8 million to 29 other vendors.
  • $1.4 million to Prismatic Development Corporation for building renovations for the Manhattan Forensic Relocation project at the Manhattan Psychiatric Center in New York City.

Department of Health

  • $65.4 million for purchases to support the COVID-19 pandemic response, including $30 million on imaging equipment from NY Medical Imaging, $10 million to provide physician, nursing, and medical support services from Execusearch Holdings, and $3.4 million for laboratory supplies and materials
  • $42.8 million to Maximus, Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.

Office of Homeland Security and Emergency Services

  • $3 million for purchases to support the COVID-19 pandemic response.

Department of Labor

  • $11 billion for Unemployment Insurance, Pandemic Unemployment Assistance and Federal Pandemic Unemployment Compensation claims.

State University of New York

  • $11.8 million for purchases to support the COVID-19 pandemic response, including $4 million to Dell Marketing LP for computers.

Department of Transportation

  • $3.9 million to Granite Construction Northeast Inc. for replacement of the Kosciuszko Bridge in Kings County.
  • $1.7 million to ECCO III Enterprises Inc. for the Kew Gardens Interchange project in Queens County.

United Court System

  • $7.2 million to The Legal Aid Society for the Attorneys for Children Program.

Payment Rejection and Other Cost Recoveries

The office rejected more than 24,400 payments valued at more than $37.7 million, including tax refunds and credits valued at more than $8.2 million. The Comptroller’s auditors also recovered more than $58,000 from vendors owing debts to the state.

Cumulatively through July for calendar year 2020, the Comptroller’s office has approved 8,453 contracts valued at $43.6 billion and has approved nearly 101 million payments worth more than $132.2 billion, including more than 86.7 million unemployment insurance payments valued at more than $37.8 billion. The office has rejected 753 contracts and related transactions valued at $3.5 billion and nearly 85,900 payments valued at more than $294.8 million primarily due to errors, improprieties or lack of documentation.
