State Contract and Payment Actions in June

In June, the Office of the State Comptroller approved 1,449 contracts for state agencies and public authorities valued at $1.5 billion and more than 3.3 million payments worth nearly $13.2 billion. The office rejected 128 contracts and related transactions valued at $1.4 billion and more than 4,900 payments valued at nearly $11.5 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Office of Cannabis Management

  • $12 million with 59 Maiden Lane Associates LLC for office space in New York County.

Office of General Services – Design & Construction

  • $8.6 million with DiPasquale Construction Inc. to construct a forensic identification unit in Genesee County.
  • $2.2 million with Proton Construction Corp. to replace roofs at Bedford Hills Correctional Facility in Westchester County.
  • $1.5 million with Kingsley Arms Inc. to remove marble soffit panels at the Cultural Education Center at the Empire State Plaza in Albany County.

Department of Health

  • $24.6 million with KPMG LLP for Health Care Reform Act performance audits.
  • $4.1 million with Public Health Law Center Inc. for development and implementation of the Center of Excellence in Tobacco Policy.

Office of Mental Health

  • $23 million with the Research Foundation for Mental Hygiene for OnTrackNY and First Episode Psychosis program administration.
  • $3.6 million with Cerner State & Local Government Services Inc. to upgrade the Clinical Laboratory System at Nathan Kline Institute.

State University Construction Fund

  • $41.1 million with Manning Squires Hennig Co. for renovations to Foster Hall at University at Buffalo.
  • $25.8 million with Concrete Applied Technologies Corp. for campus-wide loop road and utility improvements at Alfred State College.
  • $9.4 million with Black Horse Group LLC for renovations to Galbreath Hall at SUNY Morrisville.

State University of New York

  • $6.9 million with ProQuest LLC for SUNY-wide library databases serials and streaming video platforms.
  • $1.5 million with Elmer W Davis Inc. for roof replacements at Upton Hall and Butler Library at Buffalo State College.

New York State Thruway Authority

  • $9 million with Grace Industries LLC for pavement repairs on I-90 in Westchester, Rockland, Orange and Ulster counties.
  • $3.3 million with Rifenburg Construction Inc. for pavement diamond grinding and miscellaneous work in Albany County.

Department of Transportation

  • $27 million with H&L Contracting LLC for operational improvements on I-495 in Suffolk County.
  • $12.7 million with H&L Contracting LLC to rehabilitate Taxiway A at Republic Airport in Suffolk County.
  • $9.3 million with Vector Construction Corp. for bridge rehabilitation on I-81 over Route 178 in Jefferson County.
  • $9 million with Tectonic Engineering Consultants Geologists & Land Surveyors DPC for construction management services of Van Wyck Expressway capacity improvements in Queens County.

Major Payments Approved

Tax Refunds and Credits

  • $1.38 billion for 1,657,571 property tax credits.
  • $501.1 million for 192,143 personal income tax refunds.
  • $142.4 million for 22,363 corporate and other tax refunds.

Office of Children and Family Services

  • $376,000 under the Child Care Stabilization Grant to childcare providers to help cover unexpected business costs associated with the COVID-19 pandemic and to help stabilize operations so that providers may continue to provide care.

Department of Civil Service

  • $334.4 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $28 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan.

State Education Department

  • $1.02 billion in general aid to 632 school districts.
  • $586.4 million in excess cost aid for school-aged special education students to 671 school districts.
  • $329,300 in BOCES aid to three organizations.

Empire State Development Corporation

  • $8 million to 43North LLC for working capital and equity investment awards for the startup business plan competition in Buffalo.
  • $3 million to the SUNY Research Foundation for equipment and operating costs associated with the federally designated American Institute for Manufacturing Integrated Photonics Testing, Assembly and Packaging (TAP) facility located in Monroe County.
  • $1.5 million to the Saranac Lake Civic Center Inc. for a portion of the design, engineering, construction, furniture and equipment costs to upgrade the Center to support its hosting commitments for the 2023 Winter World University Games.
  • $1.2 million to Byrne Holdings Inc. for a portion of the costs of construction and equipment to expand manufacturing facilities in East Syracuse and Cortland.

Executive Chamber

  • $ 4.9 million to Arnold & Porter Kaye Scholer LLP for legal services.

Gaming Commission

  • $16.4 million to the City of Salamanca and Cattaraugus County for tribal-state compact payments.
  • $3.1 million for gaming revenue distributions from the Tioga Downs, Rivers, Montreign and Del Lago casinos to 17 local governments.

Office of General Services

  • $15.2 million for hourly-based IT services, including $4.3 million to Knowledge Builders Inc., $2.1 million to MVP Consulting Plus Inc., $1.4 million to Computer Technology Services Inc. and $7.4 million to 26 other vendors.
  • $1.7 million for purchases to support the COVID-19 pandemic response, including health management services and rent.

Department of Health

  • $37 million for purchases to support the COVID-19 pandemic response, including ambulance services, call centers, consulting services and temporary staffing services.
  • $16 million to New York eHealth Collaborative Inc. for the Statewide Health Information Network for New York.
  • $15.1 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.

Department of Labor

  • $165.8 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, and Mixed Earner Unemployment Compensation programs.
  • $2.6 million for the Excluded Workers Fund program.

New York State Legislature – Assembly

  • $2.5 million to Davis Polk & Wardwell LLP for legal services.

State University of New York

  • $3.3 million to support the COVID-19 pandemic response, including administrative and clerical services and medical and laboratory supplies and materials.

Office of Temporary and Disability Assistance

  • $161.5 million for the Emergency Rental Assistance Program.
  • $30.2 million for the Landlord Rental Assistance Program.

Other Payment Rejections and Other Cost Recoveries

OSC rejected tax refunds and credits valued at nearly $5.2 million. Auditors also recovered nearly $247,000 from vendors owing debts to the state.

Cumulatively through June for calendar year 2022, the Comptroller’s office has approved 8,703 contracts valued at $26.3 billion and has approved more than 18.4 million payments worth nearly $96.7 billion. The office has rejected 688 contracts and related transactions valued at $3.7 billion and nearly 36,200 payments valued at more than $96.9 million primarily due to errors, improprieties or lack of documentation.
