State Contract and Payment Actions in September

In September, the Office of the State Comptroller approved 1,465 contracts for state agencies and public authorities valued at $2.9 billion and approved more than 2.2 million payments worth more than $14.9 billion. The office rejected 123 contracts and related transactions valued at $348 million and more than 8,700 payments valued at more than $11.8 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Office of the Attorney General

  • $1.5 million with Research Triangle Institute for expert witness services.

City University of New York

  • $67.9 million with 569 Lexington Leasehold LLC for student housing in New York County.

Office of General Services - Design & Construction

  • $26.4 million with Prismatic Development Corp. for renovations at Creedmoor Psychiatric Center in Queens County.
  • $2.8 million with Vinco Builders LLC for latrines and locker rooms at the Peekskill Armory in Westchester County.
  • $2.1 million with John G. Waite Associates Architect PLLC for design services to rehabilitate the approach staircase, promenades, eastern portico, and executive staircase at the New York State Capitol in Albany County.

Office of Parks, Recreation & Historic Preservation

  • $10 million with Stantec Landscape Architecture and Geology PC for professional design services to rehabilitate Lake Sebago at Harriman State Park in Rockland County.
  • $5 million with James Corner Field Operations LLC for professional design services for the new Sojourner Truth State Park in Ulster County.
  • $3.8 million with James H. Maloy Inc. for Roosevelt Drive corridor improvements at Saratoga Spa State Park in Saratoga County.
  • $2.1 million with R.B. Robinson Contracting Inc. for wastewater system improvements at Thacher State Park in Albany County.

State University Construction Fund

  • $7.4 million with Northern Tier Contracting Inc. to renovate Carson Hall at SUNY Potsdam.
  • $2.4 million with Aventura Construction Corporation to replace two diesel fuel tanks at SUNY Downstate Health Sciences University.

State University of New York

  • $11.5 million with Sodexo Operations LLC for custodial management services at University at Buffalo.
  • $2.4 million with Parkline Asphalt Maintenance Inc. for storm water recharge basin restoration and maintenance at Stony Brook University.
  • $1.8 million with Troy Boiler Works Inc. for on-call high temperature welding repair service at University at Albany.
  • $1.2 million with Evans Mechanical Inc. to replace chillers at SUNY Oneonta.

Department of Transportation

  • $26.1 million with Tioga Construction Co. for bridge replacement on Route 12E over the Chaumont River in Jefferson County.
  • $8.4 million with ELQ Industries Inc. for preventive maintenance on Route 9 in Dutchess County.
  • $6.7 million with McLaughlin Construction Corp. for safety improvements on US Route 62 in Niagara County.
  • $6.7 million with United Fence and Guard Rail Corp. for guide rail rehabilitation in Suffolk County.

Major Payments Approved

Refunds and Credits

  • $568 million for 117,799 personal income tax refunds.
  • $395.5 million for 450,079 property tax credits.
  • $265.5 million for 23,821 corporate and other tax refunds.
  • $76 million for 240,020 additional child and earned income tax payments.

New York State Office of the Attorney General

  • $2.3 million to Cleary Gottlieb Steen & Hamilton LLP for legal services.

Division of Budget

  • $3.4 million to Accenture LLP for strategic consulting services in response to the COVID-19 pandemic.

Office of Children and Family Services

  • $41.6 million under the Child Care Stabilization Grant to childcare providers to help cover unexpected business costs associated with the COVID-19 pandemic and to help stabilize operations so that providers may continue to provide care.

Department of Civil Service

  • $330.6 million to Caremark Health, LLC. to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $30.4 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan.

State Education Department

  • $2.8 billion in general aid to 677 school districts.
  • $33.5 million in BOCES aid to Herkimer-Fulton-Hamilton-Otsego BOCES, Delaware-Chenango-Madison-Otsego BOCES and Onondaga-Cortland-Madison BOCES.
  • $250,000 in excess cost aid to six school districts for school-aged special education students.

Empire State Development Corporation

  • $1.7 million for the Small Business Recovery Grant Program.

Executive Chamber

  • $640,000 to Willkie Farr & Gallagher LLP for legal services.

Gaming Commission

  • $7.6 million for tribal-state compact payments to the counties of Cayuga, Chenango, Cortland, Herkimer, Lewis, Oneida, Onondaga, Oswego, and Otsego.

Office of General Services

  • $9.3 million for hourly-based IT services, including $2 million to Knowledge Builders, $1.7 million to Carahsoft Technology Corp., $1 million to MVP Consulting Plus Inc., and $4.6 million to 21 other vendors.

Department of Health

  • $20.9 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $18.9 million to support the COVID-19 pandemic response, including: $12.7 million for local grants and public assistance, which includes $3.2 million for the Food Bank for New York City, $2.4 million for the Regional Food Bank of Northeastern New York, and $1.2 million for Westchester County; $2.1 million for call centers, which includes $1.1 million to Deloitte Consulting, LLP; $1.5 million for client services which includes $1.1 million to VIP StarNETWORK, LLC for mobile vaccination sites; and $2.6 million for various other purposes.
  • $15 million to New York eHealth Collaborative Inc. for the Statewide Health Information Network for New York.

Department of Labor

  • $160.1 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation and Mixed Earner Unemployment Compensation programs.

State University of New York

  • $2.3 million to support the COVID-19 pandemic response, including: $872,000 for administrative and clerical services, which includes $324,300 to KMG Staffing Inc, $229,500 to Winston Support Services LLC, and $209,600 to Remede Consulting Group Inc; $594,300 for laboratory supplies and materials, which includes $460,000 to Qiagen LLC; and $830,000 for various other purposes.

Office of Temporary and Disability Assistance

  • $132 million for the Emergency Rental Assistance Program.
  • $4.2 million for the Landlord Rental Assistance Program.

Other Contract Payment Rejections and Other Cost Recoveries

OSC rejected tax refunds and credits valued at more than $4.1 million. The Comptroller’s auditors also recovered more than $198,700 from vendors owing debts to the state and held payments of nearly $95,200 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through September for calendar year 2022, the Comptroller’s office has approved 12,955 contracts valued at $34.1 billion and has approved more than 24.5 million payments worth nearly $131.3 billion. The office has rejected 1,064 contracts and related transactions valued at nearly $5.1 billion and nearly 49,600 payments valued at more than $181.1 million primarily due to errors, improprieties or lack of documentation.
