Special 20- and 25-Year Plans
For PFRS Tier 2, 3 (Article 11), 5 and 6 Members
(Sections 384, 384-d and 384-e)

Regular Earnings: For Tier 6 members, earned compensation that exceeds the Governor’s annual salary is excluded (please refer to our Overtime and Earnings Limits for Tier 6 page for more information). Also excluded are earnings from more than two participating employers.

Overtime: For Tier 5 and 6 members, the total amount of overtime that can be included in your FAE calculation is limited to 15 percent of earnings.

Certain public safety overtime: Your employer reports pensionable overtime earnings to NYSLRS. Generally, earnings for overtime worked for a private employer is not public service and cannot be included in your pensionable earnings. As of July 1, 2019, public safety overtime that is paid to you by a public entity and meets other requirements may count toward your retirement benefit calculation. This includes special duty assignments that involve public safety work that is directed and paid for by your employer and reimbursed by a private entity.
