Purpose:

As we await the enactment of the New York State (NYS) fiscal year 2022-23 budget, OSC would like to provide notice of the possible impact to paycheck distribution and release of direct deposit funds and advices in the event the NYS budget or an extender bill is not passed by 10am on Monday, April 11, 2022.

Affected Employees:

Executive Branch* employees paid on the Administration pay cycle may be affected, including the Governor, Lieutenant Governor, Comptroller and Attorney General; officers and employees of the judiciary; and officers and employees of the Legislature, including the Legislative staff and for payments of services performed by mentally ill or developmentally disabled persons who are employed in State-operated special employment, work-for-pay or sheltered workshop programs.

Note: Pursuant to section 5 of the Legislative Law, Legislators’ salaries cannot be paid until legislative passage of the NYS budget has occurred.

*This does not apply to employees of the State University of New York (28***, excluding SUNY Construction Fund [28990], City University of New York [70***] or State Insurance Fund [00640, 00650]) since their fiscal year does not expire until the end of June. However, although funds will be released for these agencies, direct deposit advices will not be mailed until all other advices can be released.

Background:

OSC is not permitted to distribute funds dated in the new fiscal year until the Legislature passes and the Governor signs the 2022-23 State budget or a budget extender bill to provide for the continuing operation of State government.  Due to the Administration paycheck date of Wednesday, April 13, 2022, this passage must occur by 10am on Monday, April 11, 2022, in order for there not to be an interruption in the posting of Direct Deposit funds into employee bank accounts and the distribution of paychecks.  Direct Deposit advices will be released once the NYS budget or a budget extender bill has been passed.

Effective Dates:

Effective paychecks dated April 13, 2022

OSC Actions:

OSC will provide updated information on the availability of funds for the paycheck dated April 13, 2022, via the PayServ Bulletin Board and New York State Payroll Online (NYSPO) should the NYS budget or an extender bill be late and not passed.

Agency Actions:

Agencies should notify employees of the possible impact and consult the PayServ and NYSPO bulletin boards for additional information and updates.

Agencies should notify the Division of the Treasury if special handling of paychecks is needed upon release of the April 13, 2022 paychecks.
