State Contract and Payment Actions in October

In October, the Office of the State Comptroller approved 1,958 contracts for state agencies and public authorities valued at $2.1 billion and approved more than 2 million payments worth nearly $14.6 billion. The office rejected 159 contracts and related transactions valued at $2.4 billion and nearly 2,300 payments valued at nearly $10.4 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Board of Elections

  • $3.9 million with Gaming Laboratories International LLC for voting system examination and testing services.
  • $1.4 million with Dyntek Services Inc. for intrusion detection system software.

Office of General Services

  • $1.1 million with NEPV LLC to overhaul pumps and motors at the River Front Pumping Station in Albany County.

Office of General Services – Design & Construction

  • $9.5 million with Stalco Construction Inc. to rehabilitate the Nurses Station Building at the Pilgrim Psychiatric Center in Suffolk County.
  • $4.1 million with Burns Bros Contracting LLC for the replacement of heat exchangers at the Riverview Correctional Facility in Saint Lawrence County.
  • $2.1 million with Postler & Jaeckle Corp. for the replacement of steam piping at the Harriman State Office Building Campus in Albany County.

Office of Parks, Recreation and Historic Preservation

  • $2.1 million with Coppola Services Inc. for water treatment plan upgrades at Harriman State Park in Orange County.
  • $1.5 million with ADP Group Inc. for Camp Junior building construction work at Harriman State Park in Orange County.
  • $1.3 million with Law Enforcement Psychological Services Inc. for psychological evaluations for park police candidates.
  • $1.1 million with Pulver Roofing Co. for slate roof replacement at the Saratoga Spa State Park Victoria Pool complex in Saratoga County.  

State University of New York

  • $25 million with Kivvit LLC for media buying and strategic planning services.
  • $8.5 million with Mass Park Inc. for valet parking management services at Upstate Medical University.
  • $2.7 million with Pamper Decorating for window treatment services at Stony Brook University.
  • $2.7 million with New York Industries for the Disabled Inc. for janitorial services at Stony Brook University.

State University Construction Fund

  • $14.6 million with O’Connell Electric Company Inc. for electrical upgrades on the North Campus at SUNY Brockport in Monroe County.
  • $7.3 million with Murnane Building Contractors for a fire suppression system at Upstate Medical University in Onondaga County.
  • $3.4 million with Nurzia Construction Corp. for renovations to relocate the admissions building at SUNY Purchase in Westchester County.
  • $1.4 million Chiang O’Brien Architects DPC to provide design services for the Home Economics Building at SUNY Cobleskill in Schoharie County.

Department of Transportation

  • $46.5 million to New York City for operational support of the Traffic Management Center.
  • $20 million with Cold Spring Construction Co. to replace and rehabilitate bridges over the Allegheny River in Cattaraugus County.
  • $12 million with H&L Contracting LLC for concrete pavement repairs in Suffolk County.
  • $6.7 million with Bette & Cring LLC for reconstruction of rail and station platforms in Tupper Lake, Franklin County.

Major Payments Approved

Tax Refunds and Credits

  • $2.3 billion for 281,070 personal income tax refunds.
  • $145.5 million for 24,305 corporate and other tax refunds.
  • $139.9 million for 123,713 property tax credits.
  • $1.1 million for 5,296 additional child and earned income tax payments.

Department of Civil Service

  • $362.4 million to CaremarkPCS Health LLC to provide pharmacy benefit services for the Empire, Excelsior, and Student Employee Health plans.
  • $29.5 million to Carelon Behavioral Health Inc. for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan.

State Education Department

  • $103.8 million in general aid to 90 school districts.

Empire State Development Corporation

  • $11.6 million to CenterState Corp. for Economic Opportunity for a portion of the construction and renovation costs to expand and upgrade the Tech Garden in Syracuse.
  • $5.3 million to Binghamton University for a portion of the construction, renovation, infrastructure and site work costs to establish a Health Sciences and Technology Innovation Park in Broome County.
  • $5 million to the CenterState Corp. for Economic Opportunity for the Growing Entrepreneurs & Innovators in Upstate New York (GENIUS NY) program.
  • $4.3 million to the Research Foundation for the State University of New York for equipment and operating costs associated with the American Institute for Manufacturing Integrated Photonics Testing, Assembly and Packaging (TAP) facility located in Monroe County.
  • $3.8 million to the Research Foundation for the State University of New York to establish the Innovation Hub to promote economic development in Western New York.

Gaming Commission

  • $10.8 million for tribal-state compact payments to the cities of Buffalo, Niagara Falls, and Salamanca, and to the counties of Allegany, Cattaraugus, Chautauqua, Chemung, Erie, Genesee, Livingston, Monroe, Niagara, Ontario, Orleans, Schuyler, Steuben, Wayne, Wyoming, and Yates.
  • $7.7 million to 22 localities for gaming revenue distributions for the del Lago Resort and Casino, Rivers Casino and Resort, Tioga Downs Casino, and Resorts World Catskills.

Office of General Services

  • $9.2 million for hourly-based IT services, including $2.7 million to Knowledge Builders Inc., and $6.5 million to 24 other vendors.

Department of Health

  • $26.5 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $7.1 million to One Brooklyn Health System Inc. for the Health Care Facility Transformation Program in Kings County.
  • $2.3 million to Maximus US Services Inc. for enrollment broker services for the Office of Health Insurance Programs.
  • $1.8 million to Currier McCabe & Associates Inc. for the development, implementation, and operation of the Medicaid data warehouse and the Office of Health Insurance Programs Data Mart.

Department of Labor

  • $256.5 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, and Federal Pandemic Unemployment Compensation programs.

Office of Temporary and Disability Assistance

  • $24.3 million for the Emergency Rental Assistance Program.

Department of Transportation

  • $7.3 million to El Sol Contracting ES/II Enterprises JV for bridge repairs and painting on the Gowanus Expressway in Kings County.

Unified Court System

  • $2.4 million to The Children’s Law Center for the Law Guardian Program.

Other Contract and Payment Rejections and Other Cost Recoveries

DiNapoli’s office rejected tax refunds and credits valued at nearly $4.9 million. Auditors also recovered more than $291,000 from vendors owing debts to the state and held more than $1.2 million in payments pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through October for calendar year 2023, DiNapoli’s office approved 19,620 contracts valued at $32.7 billion and approved more than 25.2 million payments worth nearly $157.1 billion. The office rejected 1,712 contracts and related transactions valued at nearly $7.1 billion and nearly 36,500 payments valued at more than $173.4 million primarily due to errors, improprieties, or lack of documentation.
