Paycheck Distribution and Release of Direct Deposit Funds in Preparation of Enactment of the 2024-25 New York State (NYS) Budget

Purpose: 

As we prepare for enactment of the 2024-25 NYS budget, OSC would like to provide notice of the possible impact to the upcoming paycheck distribution and release of direct deposit funds and advices should the NYS budget be late and a budget extender bill is not passed.

Affected Employees: 

Executive Branch* employees paid on either the Institution or Administration pay cycle may be affected.

*This does not apply to employees of the State University of New York (28***, [excluding SUNY Construction Fund 28990]), City University of New York (70***) or State Insurance Fund (00640, 00650) since their fiscal year does not expire until the end of June. However, although funds will be released for these agencies, direct deposit advices will not be mailed until all other advices can be released.

Background:

If the SFY 2024-25 budget is not passed or a budget extender bill to provide for the continuing operation of State government is not enacted, electronic direct deposit files may not be released on the normal schedule and employee financial institutions may delay posting direct deposit funds into employee bank accounts. The distribution of paychecks and direct deposit advices may also be delayed. The Division of the Treasury holds both the paychecks and electronic files until the Legislature passes and the Governor signs the 2024-25 NYS budget or a budget extender bill.

Effective Dates: 

OSC has created the attached reference for agencies, 2024 Payroll Deadline, containing the deadlines for passage of either the State Budget or a budget extender bill through the June 5, 2024 Administration paycheck. 

OSC will update this attachment if the NYS Budget is not passed prior to the June 13, 2024 Institution paycheck. 

OSC Actions: 

For each potentially impacted paycheck, OSC will transmit the electronic direct deposit file to the bank as soon as the Legislature passes and the Governor signs either the 2024-25 NYS budget or a budget extender bill to provide for the continuing operation of State government is enacted. 

Note: Some financial institutions release direct deposit funds one or two business days prior to the official NYS payday found at Payroll Calendars | Office of the New York State Comptroller (ny.gov). This early release of funds may be impacted by the timing of OSC’s transmission of the electronic direct deposit file to the bank. Employees should be made aware that a delay in these early deposits may not constitute late payment of the NYS payroll. 

Agency Actions: 

Agencies should notify employees of the possible impact, including the timing of direct deposits, and consult the PayServ and NYSPO bulletin boards for additional information and updates. 

Agencies should notify the Division of the Treasury if special handling of paychecks is needed upon release of any potentially impacted paychecks.
