Appointments of State Officers

The salaries for most Commissioners and Agency and Department Heads (O.S.-Grade 700) are listed in Section 169 of the Executive Law. The Section grants authority to the Director of the Budget to increase these salaries in some years to reflect the same percentage increases provided to Management/Confidential employees with provisions that such increase may be withheld in whole or in part, on an equal basis for all officers, by the Director of the Budget. Any increases or changes to compensation will require amendment of the Law.

These State Officers are not eligible for location pay.

Agency heads whose positions are not listed in Section 169 are paid N.S. (Grade 600) salaries determined by the Director of the Budget.

Correction Superintendents

Section 19 of the Correction Law contains salary schedules for the position of Superintendent of Correctional Facility, O.S. (Grade 700). This section provides for two schedules for Superintendents were established based on the size of the facility; one for facilities with 400 or more inmates and one for facilities with less than 400 inmates.

Under Section 18, appointments to the positions by the Commissioner of Correctional Services from employees within the Department of Correctional Services are at the hiring rate of the appropriate schedule or a higher salary, not to exceed the job rate, with the approval of the Director of the Budget. Annual performance advances, up to the job rate of the range, are provided under Rules and Regulations of the Director of the Budget. A Budget Certificate of Approval listing the increased salary is submitted prior to payment.
